The European Commission published the Interpretative Communication on the application of Community Law on Public Procurement and Concessions to Institutionalised Public-Private Partnerships. This article discusses the new publication and the guidance it gives on setting up a mixed capital, public-private partnership entity and awarding contracts to it.
